Agreement to Terms

By accessing or using Hagal, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

These terms apply to all users of the service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

If you use WhatsApp Business features through Hagal, you also agree to comply with Meta's WhatsApp Business Messaging Policy, the WhatsApp Business Terms of Service, the WhatsApp Messaging Guidelines, and any other applicable Meta or WhatsApp policies. Meta may limit or remove access to WhatsApp Business Services for policy violations.

Use License

Permission is granted to temporarily access and use Hagal for personal or commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials or software
• Use the materials for any commercial purpose or for any public display without written permission
• Attempt to reverse engineer, decompile, or disassemble any software contained in Hagal
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Hagal at any time.

Account Registration

To access certain features of our service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Acceptable Use

You agree not to use the service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful, offensive, or illegal content
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any portion of the service
• Collect or store personal data about other users without their consent
• Use automated systems to access the service without permission
• Impersonate any person or entity or misrepresent your affiliation

WhatsApp Business Messaging

Hagal provides tools to connect WhatsApp Business Accounts and send messages via the WhatsApp Business Platform. By using these features, you agree that:

Quality experience and identity

• You will follow Meta's technical and product documentation
• You will maintain an accurate WhatsApp Business profile with customer support contact information and one or more of: email address, website address, and/or telephone number
• You will not impersonate another business or entity, misrepresent your affiliation, or otherwise mislead customers as to the nature of your business
• You will not confuse, deceive, defraud, mislead, spam, or surprise people with your communications

Opt-in and opt-out

• You may only contact people on WhatsApp if they have given you their mobile phone number and you have received opt-in permission confirming they wish to receive subsequent messages or calls from you
• You are solely responsible for determining the method of opt-in, ensuring it complies with applicable law, and providing required notices and permissions
• You must respect all requests (on or off WhatsApp) to block, discontinue, or otherwise opt out of communications, including removing that person from your contacts list
• You should obtain clear opt-in covering the categories of messages you will send, provide clear opt-out instructions, and honor those requests

Message templates and the 24-hour window

• Outside the 24-hour customer service window, you may only initiate conversations using approved Message Templates, used only for their designated purpose
• Within 24 hours of the last user message, you may reply without a Message Template
• Meta has the right to review, approve, pause, and reject any Message Template at any time
• If you use automation during the 24-hour window, you must also provide prompt, clear escalation paths (for example: in-chat human agent transfer, phone, email, web support, in-store visits, or a support form)

Data protection

• You must secure all necessary notices, permissions, and consents, maintain a published privacy policy, and comply with applicable law
• Do not use data obtained from Meta about a person you message—other than message thread content—except as reasonably necessary to support messaging with that person
• Do not share or ask people to share full-length payment card numbers, financial account numbers, personal ID numbers, or other sensitive identifiers
• Do not forward or share information from a customer chat with any other customer

Prohibited use and content

You may not use WhatsApp Business features through Hagal for prohibited activities under the WhatsApp Business Messaging Policy, including without limitation:

• Terrorist or organized criminal activity, or facilitating criminal activity or harm
• Illegal products or services
• Restricted goods and services such as firearms; alcohol and tobacco (except where Meta expressly allows under regulated-vertical rules); drugs; certain medical and healthcare products; endangered species; hazardous materials; real/virtual/fake currency including ICOs and binary options; body parts or fluids; fraudulent or deceptive offerings; real-money gambling and gaming (except limited Meta-approved exceptions); adult products and services; dating services; multi-level marketing; payday loans, paycheck advances, peer-to-peer lending, debt collection, and bail bonds
• Wrongful discrimination based on personal characteristics, or offensive content such as sexually explicit materials or nudity
• Political parties, politicians, political candidates, political campaigns, law enforcement agencies, military services, national security and intelligence agencies, or related political/election service providers, as prohibited by Meta
• Commerce experiences that violate the Meta Commerce Policy

These prohibitions apply regardless of any licenses or approvals you may hold, except where Meta's policy expressly provides limited exceptions for regulated verticals (subject to age, country, licensing, and other requirements). You are responsible for complying with those requirements if you message about any allowed regulated vertical.

Enforcement

Meta and/or Hagal may limit, suspend, or terminate access to WhatsApp Business features if you receive significant negative feedback, harm users, violate these terms or Meta's policies, message people at scale in an unauthorized manner, or otherwise fail to maintain a high-quality experience. Low quality tiers may reduce message or call capacity. Termination for policy violations may result in prohibition from future use of WhatsApp products and services.

User Content

You retain ownership of any content you submit, post, or display on or through the service ("User Content"). By submitting User Content, you grant Hagal a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing and improving our services.

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to grant the license above and that your User Content does not violate any third-party rights.

Payment Terms

If you purchase a subscription or other paid service:

• You agree to pay all fees associated with your account
• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days' notice
• Failure to pay may result in suspension or termination of your account
• You are responsible for any taxes applicable to your purchase
• WhatsApp conversation and messaging fees charged by Meta are separate from Hagal subscription fees and are your responsibility according to Meta's pricing

Service Availability

We strive to provide reliable service but do not guarantee that the service will be available at all times. The service may be unavailable due to maintenance, updates, or circumstances beyond our control, including outages or policy enforcement by Meta, WhatsApp, or other channel providers. We are not liable for any loss or damage resulting from service unavailability.

Intellectual Property

The service and its original content, features, and functionality are owned by Hagal and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. WhatsApp, Meta, and related marks are trademarks of their respective owners.

Disclaimer

The materials and services on Hagal are provided on an "as is" basis. Hagal makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement of intellectual property or other violation of rights
• Accuracy, reliability, or completeness of information

Limitation of Liability

In no event shall Hagal or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Hagal, even if Hagal or an authorized representative has been notified orally or in writing of the possibility of such damage.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service or applicable Meta/WhatsApp policies.

Upon termination, your right to use the service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of the service after any such changes constitutes your acceptance of the new Terms of Service. Meta may update the WhatsApp Business Messaging Policy independently; continued use of WhatsApp features constitutes acceptance of those changes as between you and Meta.
